Zylum Ltd is a limited company with a not-for-profit status based at Peace House, 5 Caledonian Road, London, England N1 9DY. It is owned by Peace News Ltd. Zylum has been set up by Peace News to further ‘The building of a pacifist society based on nonviolent means of resolving social and international conflict and the abolition of war and the promotion of international peace by providing digital services for people struggling for peace and justice’. As a responsible member of the global internet community and as a legal entity doing business in the UK, Zylum must also ensure that our systems are being used to further our mission in compliance with our own ethics and principles, and appropriate laws and conventions.
Therefore we need you, the user, to agree to the following terms and conditions.
You can accept the user agreement by:
(a) clicking to accept or agree to the agreement, where this option is made available to you by Zylum in the user interface for any service; or
(b) by actually using Zylum services. In this case, you understand and agree that Zylum will treat your use of its services as acceptance of these terms and conditions from that point onwards.
Zylum services currently include email list hosting and website hosting. These services may change from time to time and are provided as is. You, the user, understand and agree that Zylum assumes no responsibility for, among other things, any service outages or interruptions, the unavailability of particular features or services, and your inability to access or make use of all or part of our services.
Furthermore, you understand and agree that Zylum assumes no responsibility for deletion, loss or mis-delivery of information stored or delivered through our services. Zylum makes no warranties or guarantees as to the security of any machine or website operated or hosted by Zylum, nor do we make any warranties or guarantees at all.
While Zylum shall attempt to ensure the highest reliability of its hardware, software and system content, it shall bear no responsibility for any damages accruing to site owners because of system failures or content inaccuracy. Site owners shall use the system at their own risk.
Zylum services shall not be used to plan or carry out any activities which are illegal under national or international law. To clarify: we note that a wide range of political activities have been prosecuted in the UK but found to be legally justified by juries.
Zylum does not claim ownership of content you upload or otherwise transmit through our servers or networks. All user content on Zylum, except where otherwise noted, is non-copyrighted. It is our intent to distribute information to as broad a spectrum of people as possible. However it is up to the users of the system to abide by all applicable copyright laws. Therefore, all material posted should contain appropriate source references where applicable. You must not post material which is in breach of copyright or any other intellectual property rights. If you wish to post material protected by any such rights it is your responsibility to obtain the owners’ written permission.
In consideration for your use of Zylum services you agree to the following conditions:
You acknowledge and agree to not sell, resell or exploit the use of our services, access to our services or any of the content accessible through our services for any commercial purposes except to use such information or content for the sole purpose of listing our service in a search engine or other service directing users to our site. Our primary purpose is not to provide a commercial service. If we find that commercial activities are taking place which detract from the quality and function of our network, we reserve the right to curtail such usage. Under such circumstances, the opportunity for dialogue and negotiation will always be provided.

You agree also, when using the service, to observe all applicable data protection legislation. The UK Data Protection Act 1998 sets out principles which must be complied with to ensure fair and lawful processing of personal data.
Save as expressly set out in this agreement all conditions or warranties which may be implied or incorporated into this agreement by law or otherwise are hereby expressly excluded to the extent permitted by law.
In no event will Zylum be liable for any indirect or consequential loss or damage of any kind (including without limitation loss of profits, business interruptions, or loss, corruption or misdelivery of data) however caused and whether arising under contract, tort (including negligence) or otherwise.
You the user agree to indemnify Zylum against any claims brought by a third party resulting from your use of our services and in respect of any losses or liabilities incurred directly by Zylum as a result of your breach or non-observance of any of these terms and conditions.
You the user shall defend and pay all costs, damages, awards, fees (including any reasonable legal fees) and judgements awarded against Zylum arising from any such claims and shall provide Zylum with notice of such claims, full authority to defend, compromise or settle such claims and reasonable assistance necessary to defend such claims, at your sole expense.
You agree that Zylum’s network vendor(s) shall be third-party beneficiaries of the above provisions of this agreement.
If you do not fulfill your obligations under this agreement, or you solicit others to breach their agreement with Zylum, or for any other reason or no reason, at Zylum’s sole discretion and without limiting its other remedies, Zylum may terminate your access to part or all of our services.
Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
You agree that Zylum may amend this agreement at any time by posting the amended terms on our site at http://zylum.org/terms. We will contact you via email when any changes are made. All amendments shall automatically be effective 10 days after they are initially posted on our site. Your use of our services following the effective date of any modifications shall constitute your binding acceptance of those modifications. Furthermore, you agree that this agreement and all incorporated agreements may be automatically assigned by Zylum, in our sole discretion, to a third party in the event of a merger, acquisition or other transfer. This agreement may not be otherwise amended except by Zylum. This agreement was last modified 10 January 2015.
You agree that Zylum may terminate your use of any Zylum services at any time and for any reason whether you violate this agreement or not. You further understand and agree that Zylum, at its complete discretion, may remove or alter the services or any of the content available through them at any time and for any reason or no reason.
Zylum respects the rights of others. If you have a complaint regarding abuse of our services, please send an email to firstname.lastname@example.org. Zylum will review the complaint and, at our sole discretion, take the action we believe to be appropriate.
The terms and conditions contained in this agreement constitute the entire agreement between Zylum and its users and supersede all other communications.
You the user acknowledge that you have read and accept the terms of this agreement. Use of Zylum services shall be deemed as acceptance of the terms of this user agreement.
This agreement shall be governed by and construed in accordance with the laws of England and Wales and you the user hereby submit to the exclusive jurisdiction of the courts of England and Wales.
